APPEAL AND ERROR — Reversal and remand upon confession of error.

Where an appeal is filed in this court, and the defendant in error upon due consideration files a confession of error which is reasonably sustained by the record, this court may reverse and remand the cause upon such confession of error.

Appeal from District Court, Tulsa County; Horace Ballaine, Judge.

Action by Savannah Guess et al. against Vernon F. Seaman, to quiet title. From a judgment for the defendant, plaintiffs appeal. Reversed and remanded, with directions.

George W. Reed, Jr., of Tulsa, for defendant in error.


After this proceeding was commenced to review the order and judgment of the trial court, the defendants in error filed a confession of error. Reversed.
