Dear Counsel:

The Court is satisfied that the positions of each party were satisfactorily set forth in the briefing of the motions for summary judgment. I do not agree with the defendant's position that the Court has misapprehended the law and/or the facts.

The responsibility for the cleanup should fall on the party responsible for the common elements where the problem occurred.

Defendant's Motion for Reargument is denied.

IT IS SO ORDERED.
