Roel GUERRA, Appellant v. Maria Fabiola GUERRA and Elma Guerra Chavez, Appellees
From the 229th Judicial District Court, Starr County, Texas Trial Court No. DC-23-226 Honorable Baldemar Garza, Judge Presiding.
ORDER
Lori Massey Brissen, Justice.
The clerk's record and the reporter's record were due on the extended due date of October 4, 2024. On the extended due date, the Bexar County District Clerk notified this court that
Appellant has not yet paid for the clerk's record. On October 8, 2024, Court Reporter Vanessa L. Carranza advised this court that Appellant has not yet paid for the reporter's record.
We order Appellant to provide written proof to this court within TEN DAYS of the date of this order that (1) the clerk's fee has been paid or arrangements have been made to pay the clerk's fee, and (2) the reporter's fee has been paid or arrangements have been made to pay the reporter's fee, or (3) Appellant is entitled to appeal without paying the clerk's or the reporter's fee.
If Appellant fails to respond as ordered regarding the clerk's record, this appeal will be dismissed for want of prosecution without further notice. See Tex. R. App P. 37.3(b).
If Appellant fails to respond as ordered regarding only the reporter's record, then Appellant must file a brief with this court within THIRTY DAYS after the clerk's record is filed, and the court will only "consider and decide those issues or points [raised in Appellant's brief] that do not require a reporter's record for a decision." See id. R. 37.3(c).
If Appellant timely complies with this order, the reporter's record will be due THIRTY DAYS after Appellant files written proof showing compliance with this order. See id. R. 35.3(c) (limiting an extension of time to file the record in a regular appeal to thirty days).
