MEMORANDUM OPINION AND ORDER


The Court has reviewed the parties' submissions regarding the content and form of the Order of Permanent Injunction and will today issue an Order of Permanent Injunction. In connection with its proposed Order of Permanent Injunction, defendant Solid Clothing Inc. ("Solid") asserts that "some designations including `05' have been determined by the Court not to be infringing because they are non-trademark uses (e.g., `CLASS OF 05')." (Emphasis in original).

The Opinion and Order of July 11, 2002, speaks for itself. Solid is advised, however, that it should not rely on that Opinion and Order as authorization for the use by Solid of the number "05" on garments or any other objects in conjunction with the designation "CLASS OF."
