G.T. McGovern Trucking Co., Inc. v. Moses

Appellate Division of the Supreme Court of New York, First Department
May 16, 1950
277 A.D. 758 (N.Y. App. Div. 1950)

Opinion

May 16, 1950.

Present — Peck, P.J., Callahan, Van Voorhis and Shientag, JJ.

Judgment and order unanimously affirmed, with costs to the respondents. Assuming that the plaintiff had a right to bring this form of action we think, nevertheless, that the complaint is insufficient as a matter of law.
