Grzeskowiak v. Lucas

Appellate Division of the Supreme Court of New York, Third Department
Oct 27, 1967
28 A.D.2d 1055 (N.Y. App. Div. 1967)

Opinion

October 27, 1967

Appeal from a judgment of the County Court of Schenectady County entered on jury verdicts in favor of the respondents. The liability issues presented in this case were solely questions of fact for the jury, and we can find no reasons advanced to disturb its determination. Similarly, the amount of the verdicts returned upon uncontradicted testimony does not impress us as unconscionable. Judgment affirmed, with costs. Gibson, P.J., Herlihy, Reynolds, Aulisi and Staley, Jr., JJ., concur in memorandum by Reynolds, J.
