THE COURT:

It is ordered that the opinion filed herein on September 15, 2005 (132 Cal.App.4th 977;___Cal.Rptr.3d___), be modified as follows:

On page 26 [132 Cal.App.4th 989, advance report], the second sentence of the Disposition and the parenthetical citation immediately following are deleted so that the Disposition now reads:

The petition is denied. Ridgeway is awarded costs on appeal.

This modification changes the judgment.

Petitioners’ petition for rehearing is denied.
