EMINENT DOMAIN, § 418damages, propriety. In action for damages sustained by property owner as result of construction of a viaduct, judgment for plaintiff for $24,084.14 was proper, where it was practically conceded that some damages were due plaintiff, the amount was fixed on trial by judge and jury upon view of premises, and witnesses variously estimated damage at from $5,000 to $45,000.

Appeal from Circuit Court of Cook county; Hon. DANIEL P. TRUDE, presiding.

Affirmed. Heard in third division, first district, this court at April term, 1938.
