DECISION & ORDER ON MOTION

Motion by Marguerite Holmes as administrator of the estate of James Cecere, to be substituted for the deceased respondent, James Cecere, as the respondent on an appeal from a judgment of the Supreme Court, Westchester County, dated August 12, 2011.

Upon the papers filed in support of the motion and no papers have been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the caption is amended as set forth above; and it is further,

ORDERED that on or before May 15, 2013, Marguerite Holmes as administrator of the estate of James Cecere, by counsel, shall advise the Court, in writing, whether she adopts the brief filed on behalf of James Cecere on February 1, 2012, or whether she will serve and file a replacement brief.
