THOMPSON, Justice. Defendant's counsel filed a suggestion of death, pointing out that defendant died in prison pending this appeal. Accordingly, the appeal is dismissed as moot. Grogan v. State, 248 Ga. 312 ( 283 S.E.2d 899) (1981); Buttrum v. State, 248 Ga. 306 ( 283 S.E.2d 899) (1981); McClendon v. State, 220 Ga. App. 205 ( 469 S.E.2d 551) (1996).
Accordingly, this appeal is DISMISSED as MOOT. See Dorsey v. State, 272 Ga. 283 (528 S.E.2d 257) (2000); Grogan v. State, 248 Ga. 312 (283 S.E.2d 899) (1981).
A suggestion of death has been filed by appellant's counsel in accordance with Court of Appeals Rule 43 (a), advising that the appellant died on December 12, 1995. The appeal in the case sub judice is therefore dismissed as moot. Grogan v. State, 248 Ga. 312 ( 283 S.E.2d 899). Appeal dismissed. Andrews and Blackburn, JJ., concur.
