Oct 19, 2001
797 So. 2d 638 (Fla. Dist. Ct. App. 2001)

Opinion

No. 5D00-3383.

October 19, 2001.

Appeal from the Circuit Court for Lake County, T. Michael Johnson, Judge.

James B. Gibson, Public Defender, and M.A. Lucas, Assistant Public Defender, Daytona Beach, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Mary G. Jolley, Assistant Attorney General, Daytona Beach, for Appellee.

Although we agree with appellant that the complained-of evidentiary ruling concerning Mr. Jowers' proffered testimony was erroneous, in light of all the other evidence in this case, the error was harmless beyond a reasonable doubt.

AFFIRMED.

PALMER and ORFINGER, R. B., JJ., concur.
