ORDER

Elizabeth Crewson Paris, Judge.

This case is calendared for trial at the Court's May 8, 2023, Omaha, Nebraska Trial Session.

On March 7, 2023, docket entry 8, respondent filed with the Court a Motion for Summary Judgment pursuant to the provisions of Tax Court Rule 121, of the Tax Court Rules of Practice and Procedure for summary adjudication in respondent's favor upon all issues presented in this case. Respondent respectfully states that counsel of record has reviewed the administrative file, the pleadings, and all written proof submitted, and based on this review, concludes that there is no genuine issue of material fact for trial. Counsel for respondent discussed this motion with petitioner. The petitioner is consulting with his Power of Attorney and has not yet determined whether or not he objects to the motion. Accordingly, respondent is unaware of whether petitioner objects to the granting of this motion

After due consideration, and for cause, it is

ORDERED that, on or before April 3, 2023, petitioner shall file with the Court and serve on respondent a response to respondent's Motion for Summary Judgment filed March 7, 2023, docket entry 8.

Petitioner is advised that failure to file a response as directed may result in the granting of respondent's Motion or other appropriate action by the Court.s
