In lieu of granting leave to appeal, the judgment of the Court of Appeals is vacated, and the case is remanded to the Worker's Compensation Appellate Commission for reconsideration in light of Haske v. Transport Leasing, Inc, 455 Mich. 628 (1997). MCR 7.302(F)(1). The motion to dismiss is denied without prejudice to the defendant's ability to raise the issue before the WCAC. Jurisdiction is not retained.
