Opinion
No. 04-17-00496-CR
12-11-2017
From the 198th Judicial District Court, Kerr County, Texas
Trial Court No. B12462
Honorable N. Keith Williams, Judge Presiding
ORDER
On November 14, 2017, we advised Appellant Tracy Diane Grier that the reporter's record was overdue and we ordered her to provide written proof by November 24, 2017, that the reporter's record has been paid or that she is entitled to a free record. We warned her that if she did not timely file her response, her brief would be due on December 14, 2017, and we would only consider those issues or points raised in Appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(c).
On December 4, 2017, Appellant filed a response. She states she is indigent, cannot afford to pay for the reporter's record, expresses concerns about the process by which she was determined to be not indigent, and asks this court to copy her husband on all documents filed in this case.
Because Appellant has not paid for the reporter's record and has not shown she is entitled to a free reporter's record, her appellate brief is due on December 14, 2017. See id. If Appellant needs additional time to file her brief, she may ask for more time by filing a motion for extension of time to file her brief that includes the following information:
• the current deadline for filing the brief,
• the number of additional days asked for to file the brief, and
• the facts supporting the need for an extension. See TEX. R. APP. P. 10.5(b).
We also advise Appellant that any member of the public may access the documents filed in this appeal through the court's website, www.txcourts.gov/4thcoa.aspx, and entering the number of the appeal: 04-17-00496-CR.
