Now, upon reading and filing the affidavit of Delmar Grice, sworn to May 29, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and
It is further ORDERED that Timothy P. Donaher, Esq., Monroe County Public Defender, 10 North Fitzhugh Street, Rochester, New York 14614, is hereby assigned as counsel for petitioner-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529.
