KERRY GREMILLION v. CONNOR J. SMITH, LIBERTY MUTUAL INSURANCE COMPANY


In Re: Connor J. Smith and Liberty Personal Insurance Company, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 649,743. BEFORE: HIGGINBOTHAM, CRAIN AND HOLDRIDGE, JJ.

WRIT DENIED. The trial court did not err in denying defendants/relators Connor J. Smith and Liberty Mutual Insurance Company's Motion to Enforce Settlement. Even though there was an agreement between the parties to compromise the claim, the agreement necessarily presumed that payment would be made in a reasonable time. Herein, we do not find that the trial court was manifestly erroneous in finding that the two-and-a-half month delay in payment was unreasonable and the agreement was no longer valid.
