JOSE I. GREGORIO, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge

On July 23, 2024, the Court received from the parties in the above-docketed matter a Proposed Stipulated Decision purporting to resolve this litigation. However, review shows that such decision would appear to be premature. The case was remanded to Internal Revenue Service of a further administrative hearing, and no supplemental notice of determination has yet been filed with the Court to terminate the remand. Moreover, such supplemental determination, once issued and filed with the Court, should be referenced in the Proposed Stipulated Decision, along with the original notice of determination.

The premises considered, and for cause, it is

ORDERED that the Proposed Stipulated Decision, filed July 23, 2024, is hereby deemed stricken from the Court's record in this case.
