DECISION & ORDER ON MOTION
Appeal and cross appeal from an order of the Supreme Court, Kings County, dated October 2, 2017, and appeal from an order of the same court dated September 4, 2019. Motion by Anna Gregorian, as administrator of the estate of Hovsep Gregorian, to be substituted for the deceased appellant-respondent, Hovsep Gregorian, under Appellate Division Docket No. 2018-01374 and the deceased appellant, Hovsep Gregorian, under Appellate Division Docket No. 2019-10749, to amend the captions accordingly, and to substitute Ruta Soulios & Stratis, LLP, as counsel for the appellant-respondent, and the appellant, in the respective matters.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branches of the motion which are to substitute Anna Gregorian, as administrator of the estate of Hovsep Gregorian, for the deceased appellant-respondent, Hovsep Gregorian, under Appellate Division Docket No. 2018-01374 and the deceased appellant, Hovsep Gregorian, under Appellate Division Docket No. 2019-10749, and to amend the captions accordingly, are granted; and it is further, ORDERED that the branch of the motion which is to substitute Ruta Soulios & Stratis, LLP, as counsel is denied as unnecessary; and it is further, ORDERED that on the Court's own motion, the time of New York Life Insurance Co. to serve and file a brief in connection with the appeal under Appellate Division Docket No. 2019-10749 is extended, and on or before September 29, 2021, New York Life Insurance Co. shall serve and file a brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
