DARIEL DESHAUN GREENWOOD, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 5th District Court Bowie County, Texas Trial Court Nos. 24F0622-005, 21F1012-005, & 21F1022-005
Before Stevens, C.J., van Cleef and Rambin, JJ.
ORDER
Court reporter Una B. King recorded the trial court proceedings in appellate cause numbers 06-24-00138-CR, 06-24-00139-CR, and 06-24-00140-CR, styled Dariel Deshaun Greenwood v. The State of Texas, trial court cause numbers 24F0622-005, 21F1012-005, and 21F1022-005, in the Fifth Judicial District Court of Bowie County, Texas. The reporter's record was originally due in this matter on September 24, 2024. That deadline was extended two times by this Court, on King's requests, resulting in the most recent due date of November 4, 2024. Although we warned King that further extension requests would not be granted, absent a showing of extraordinary circumstances, she has nonetheless filed a third request for an extension of the filing deadline, seeking an additional ten-day extension of time.
The Texas Rules of Appellate Procedure establish that "trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed." Tex.R.App.P. 35.3(c). The rules further instruct that an "appellate court may enter any order necessary to ensure the timely filing of the appellate record." Id. In furtherance of our responsibilities established by the rules, we find we must take steps to ensure that the record in this case is filed in a reasonable amount of time.
We, therefore, deny King's third request for an extension of the filing deadline and order her to file the reporter's record in cause numbers 06-24-00138-CR, 06-24-00139-CR, and 06-24-00140-CR, styled Dariel Deshaun Greenwood v. The State of Texas, trial court cause number 24F0622-005, 21F1012-005, and 21F1022-005, in the Fifth Judicial District Court of Bowie County, Texas, to be received no later than November 14, 2024.
If the reporter's record is not received by November 14, we warn King that we may begin contempt proceedings and order her to show cause why she should not be held in contempt of this Court for failing to obey its order.
IT IS SO ORDERED.
