Decision Pursuant to Rule 1:28.

The judgment is modified in part to declare (1) the omission of the slivered parcel in the deed from Cook to Joseph reflected a mutual mistake of the parties, and (2) Cook lacked capacity to transfer the slivered parcel to Brenda in 1992. The remainder of the judgment is vacated and the matter is remanded to the Superior Court for further action consistent with the memorandum and order of the Appeals Court.
