2004 N.Y. Slip Op. 50105 (N.Y. App. Term 2004)

Opinion

2003-468 N C.

Decided February 5, 2004.

Appeal by plaintiff on the ground of inadequacy from a small claims judgment of the District Court, Nassau County, (K. Gartner, J.), entered on November 25, 2002, which awarded plaintiff the principal sum of $150.

Judgment unanimously affirmed without costs.

PRESENT: McCABE, PJ., RUDOLPH and ANGIOLILLO, JJ.

In this action seeking to recover damages that plaintiff claims were caused by defendant when it reupholstered two chairs, we find that the trial court properly rendered its judgment providing the parties with substantial justice according to the rules and principles of substantive law (UDCA 1804, 1807; see Ross v. Friedman, 269 AD2d 584; Williams v. Roper, 269 AD2d 125, 126).
