On May 18, 2016, we withdrew the submission date and abated this appeal pending resolution of the petition for writ of certiorari filed in the United States Supreme Court. On May 27, 2016, appellant filed a copy of the United States Supreme Court's notice stating that the petition for certiorari was denied. Accordingly, it is ORDERED that this appeal is REINSTATED on the docket of this court. The appeal is set for formal submission ON BRIEFS ONLY before this Court on June 29, 2016 before a panel consisting of Chief Justice Marion, Justice Martinez, and Justice Chapa.
