Opinion
Supreme Court Case No: 2023SA167
07-06-2023
In re the Marriage of: Barbara Henderson GREEN, Petitioner, v. Jeffry Howard GREEN, Respondent.
ORDER AND RULE TO SHOW CAUSE
Upon consideration of the Petition for Rule to Show Cause Pursuant to C.A.R. 21 filed in the above entitled action and matter, and being sufficiently advised in the premises,
IT IS ORDERED that a Rule to Show Cause issue out of this court. Therefore, Respondent, Barbara Henderson Green is directed to answer, in writing, on or before August 3, 2023, why the relief requested in the petition should not be granted.
IT IS FURTHER ORDERED that Petitioner, Jeffry Howard Green, has 21 days from receipt of the answer within which to reply.
Pursuant to C.A.R. 21(f)(2), all further proceedings are stayed until further order of this court.
IT IS FURTHER ORDERED that the parties should address, in their response to this Rule to Show Cause and reply, respectively, how the question of personal jurisdiction is to be determined in a dissolution of marriage proceeding when the parties are domiciled in different states, such that each party could potentially argue a lack of general personal jurisdiction if the proceeding is filed in the state in which the other party is domiciled.
