By Order dated January 11, 2023, docket entry 11, the Court: (1) retained jurisdiction of this case; (2) struck this case for trial from the January 30, 2023, Birmingham, Alabama remote Trial Session and continued this case; and (3) directed the parties by February 9, 2023, to submit a Proposed Stipulated Decision document or file a Joint Status Report with the Court.

On February 9, 2023, docket entry 12, respondent filed a Status Report, indicating that respondent is awaiting computations and therefore is requesting an additional thirty (30) days to submit a decision document for this case. By Order dated February 16, 2023, docket entry 13, the Court directed the parties, on or before March 20, 2023, to submit a Proposed Stipulated Decision document or file a Joint Status Report. On March 20, 2023, docket entry 14, respondent filed with the Court a Status Report which indicates that respondent has conceded this case and has sent decision documents to petitioner but has not received the signed decision as of the date of this filing. Respondent requested an additional thirty (30) days to submit a decision document for this case. To date, no decision document has been submitted.

Therefore, to move this case forward, the Court will schedule this case for trial at the Birmingham, Alabama remote Special Trial Session commencing on Tuesday, June 20, 2023.

The Court requests that the parties follow the Standing Pretrial Order for the Court's June 20, 2023, Birmingham, Alabama remote Special Trial Session. A Standing Pretrial Order will be separately served on the parties. Any sixty (60) day deadlines in the Standing Pretrial Order will be treated as forty-five (45) day deadlines for this remote Special Trial Session.

After due consideration, it is

ORDERED that, on or before May 30, 2023, the parties shall submit decision documents or file a Joint Status Report with the Court as to the then-present status of this case. It is further

ORDERED that this case is set for trial at a remote Special Trial Session scheduled to commence on Tuesday, June 20, 2023, at 10:00 a.m. CT (11:00 a.m. ET) where Birmingham, Alabama shall be listed as the place of trial for this remote Special Session. It is further

ORDERED that the Clerk of the Court shall also serve on the parties: (1) a Notice of Remote Proceeding that shall contain comprehensive instructions on how to participate in the above-referenced remote proceeding and (2) a copy of the Standing Pretrial Order for the Court's June 20, 2023, Birmingham, Alabama, remote Special Trial Session. It is further

ORDERED that any sixty (60) day deadlines in the Standing Pretrial Order will be treated as forty-five (45) day deadlines for this remote Special Trial Session.
