ORDER OF DISMISSAL AND DECISION

On February 27, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. On March 1, 2023, the Court calendared a hearing at the trial session scheduled to commence on March 20, 2023, in Seattle, Washington.

This case was called from the calendar of the Court's March 20, 2023 trial session in Seattle, Washington. There was no appearance by or on behalf of the petitioner. Respondent's counsel appeared and were heard on the motion.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is granted, and this case is dismissed for lack of prosecution. It is further

ORDERED AND DECIDED: That there is a deficiency in income tax due from petitioner for tax year 2018 in the amount of $8,860.00.
