Great Plains National Bank v. Leppert

Supreme Court of North Dakota
Dec 15, 2009
799 N.W.2d 406 (N.D. 2009)

Opinion

No. 20090119.

Decided December 15, 2009.

Appeal from the District Court of Barnes County, Southeast Judicial District, the Honorable Mikal Simonson, Judge.

AFFIRMED.

Jonathan R. Fay (argued), Dakota Center Bldg., 51 Broadway, Ste. 600, Fargo, N.D. 58102-4933, plaintiff and appellee.

Sam Leppert (argued) and Laura Leppert (appeared), self-represented, defendants and appellants.

[¶ 1] Sam and Laura Leppert appealed from an amended judgment in favor of Great Plains National Bank. On appeal, they argue the Bank did not prove standing; the affidavit of the Bank's employee lacked foundation; the Bank did not produce conclusive evidence to support the allegations in its amended complaint; and the Bank is required by law to follow generally accepted accounting principles. We summarily affirm under N.D.R.App.P. 35.1(a)(6).

[¶ 2] Gerald W. VandeWalle, C.J.

Dale V. Sandstrom

Daniel J. Crothers
