It has come to the Court's attention that attorney Carl White is not representing appellant on appeal.
We ORDER the trial court to hold a hearing within THIRTY DAYS of the date of this order and make findings whether appellant is indigent; whether he has retained counsel for appeal; and the identity of retained counsel. If the trial court finds appellant is indigent and has not retained counsel, then the trial court shall appoint counsel to represent appellant on appeal. If the trial court finds that appellant is not indigent and has not retained counsel, then the trial court shall admonish appellant of the dangers of self representation and shall make a finding whether appellant intends to retain counsel or whether appellant intends to proceed pro se.
The trial court's findings including the identity of retained or appointed counsel shall be filed within FORTY-FIVE DAYS of the date of this order. The reporter's record of the hearing shall be filed within FORTY-FIVE DAYS of the date of this order.
We DIRECT the Clerk to send copies of this order to the Honorable James Fallon, Presiding Judge, 15th Judicial District Court; Kelly Ashmore, Grayson County District Clerk; Lori Barnett, Official Court Reporter, 15th District Court; Carl White, Attorney; and counsel for all parties.
We further DIRECT the Clerk to send a copy of this order by first class mail to Lazziert La'Shawn Gray, TDCJ # 02493606, Beto Unit, 1391 FM 3328, Tennessee Colony, TX 75880.
We ABATE this appeal for the trial court to comply with this order. The appeal shall be reinstated when the Court receives the trial court's findings or at such other time as the Court deems appropriate.
