On June 1, 2021, respondent filed a Motion for Partial Summary Judgment together with a Memorandum of Law in Support of Motion for Partial Summary Judgment and Declaration of Stephen C. Welker in Support of Motion for Partial Summary Judgment. On January 31, 2022, this case was assigned to the undersigned judge for the disposition of respondent's motion. By Order served February 8, 2022, petitioner was directed to file a response to respondent's Motion for Partial Summary Judgment on or before April 8, 2022. By same Order, the parties were directed on or before April 8, 20222, to file separately or jointly a report as to the then current status of this case and (1) what issues remain for decision if respondent's Motion for Partial Summary Judgment is granted, and (2) what issues for decision remain if respondent's Motion for Partial Summary Judgment is denied.
On March 29, 2022, petitioner filed an unopposed Motion for Extension of Time for Petitioner to Respond to Respondent's Motin for Partial Summary Judgment. Upon due consideration, it is hereby
ORDERED that petitioner's Motion or Extension of Time for Petitioner to Respond to Respondent's Motion for Partial Summary Judgment filed March 29, 2022, is granted in that the time within which petitioner shall file a Response to respondent's Motion for Partial Summary Judgment is extended from April 8, 2022, to July 8, 2022. It is further
ORDERED that the time within which the parties shall jointly or separately, report to the Court as to the then current status of this case and (1) what issues remain for decision if respondent's Motion for Partial Summary Judgment is granted, and (2) what issues for decision remain if respondent's Motion for Partial Summary Judgment is denied is extended from April 8, 2022, to July 8, 2022.
