A Case of Original Jurisdiction – Prohibition. Lower Tribunal No. 21-7060

Perez Mayoral, P.A., and Michael P. Mayoral, for petitioner.

Vernis & Bowling of Miami, P.A., and Evelyn Greenstone Kammet and Mark Erdman, for respondent.

Before EMAS, MILLER and LOBREE, JJ.

PER CURIAM.

Leslie Gratz petitions for a writ of prohibition seeking disqualification of the trial judge. We find that the sworn allegations in his motion for disqualification are sufficient to place a reasonably prudent person in fear of not receiving a fair hearing on his legal claims. See Castillo v. Castillo, 150 So. 3d 1255, 1255-1256 (Fla. 4th DCA 2014); Wade v. Wade, 123 So. 3d 697, 698 (Fla. 3d DCA 2013).

Petition for writ of prohibition granted.
