An appeal having been taken to this Court from an order of the Supreme Court, Bronx County, entered on or about June 16, 2020,

And plaintiff-respondent having moved to dismiss the aforesaid appeal on the grounds that defendants failed to timely file a proper notice of appeal (M-2021-00151),

And defendants-appellants having moved for an extension of time in which to file an amended notice of appeal, nunc pro tunc, to July 23, 2020 (M-2021-00248),

Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,

It is ordered that the motion to dismiss the appeal is denied (M-2021-00151), and

It is further ordered that defendants-appellants' motion is granted to the extent of deeming defendants' amended notice of appeal, dated July 23, 2020, as timely filed and served (M-2021-00248). ENTERED: March 04, 2021
