This case is calendared for trial at the Trial Session of the Court scheduled to commence on February 13, 2023, at the U.S. Custom House located at 200 Chestnut Street, Philadelphia, Pennsylvania 19106, Room 300, 3rd Floor.
On January 4, 2023, the parties filed with the Court a Proposed Stipulated Decision (Index No. 9) and concurrently filed a Settlement Stipulation (Index No. 10). Also on January 4, 2023, respondent filed an Entry of Appearance for Respondent. On January 5, 2023, the parties filed with the Court a second Proposed Stipulated Decision (Index No. 12) and concurrently filed a Settlement Stipulation (Index No. 13). The Court spoke with respondent's counsel to confirm which proposed decision document was the correct document. Respondent's counsel informed the Court that the second Proposed Stipulated Decision (Index No. 12) and Settlement Stipulation (Index No. 13) were the documents the parties wish for the Court to sign. Respondent's counsel informed the Court that the first set of documents were had been filed with the Entry of Appearance for Respondent unintentionally. For that reason, the Court will strike the initial Proposed Stipulated Decision (Index No. 9) and Settlement Stipulation (Index No. 10) from the record.
Upon due consideration, and for cause, it is
ORDERED that the parties' Proposed Stipulated Decision at Index No. 9, filed with the Court on January 4, 2023, is hereby stricken from the record. It is further
ORDERED that the parties' Settlement Stipulation at Index No. 10, filed with the court on January 4, 2023, is hereby stricken from the record.
