On February 1, 2023, the Commissioner filed a motion for leave to file motion to vacate and lodged a motion to vacate decision and stipulation to which Mr. Grant did not object. For the reasons stated in the Commissioner's motion, it is

ORDERED that the Commissioner's motion for leave to file motion to vacate is granted. It is further

ORDERED that the Commissioner's motion to vacate shall be filed as of the date of this Order. It is further

ORDERED that the Commissioner's motion to vacate is granted and the stipulated decision entered on December 28, 2022, is vacated. It is further

ORDERED that the parties shall submit a proposed stipulated decision by February 24, 2023.
