In lieu of granting leave to appeal, the case is remanded to the Court of Appeals. MCR 7.302(F)(1). On remand, the Court of Appeals must treat the plaintiff's "claim of appeal" as an application and decide, based on the merits of the application whether to grant or deny it. See also MCR 7.104(D)(2)(b). Jurisdiction is not retained.
