GRAHAM v. NEFF

Supreme Court of Michigan
Nov 2, 1999
461 Mich. 906 (Mich. 1999)

Opinion

No. 112343.

November 2, 1999.

On order of the Court, the application for leave to appeal from the February 25, 1998 decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the February 25, 1998 order of the Court of Appeals and we REMAND this case to the Court of Appeals for plenary consideration. On remand, the Court of Appeals shall consider whether an "occurrence" triggered coverage under the policy and, if so, whether the release was "sudden and accidental" so as to escape application of the pollution exclusion. SeeMatakas v Citizens Mut Ins Co, 202 Mich. App. 642; 509 N.W.2d 898 (1993).

Court of Appeals No. 206908.
