Appeal from the 40th District Court, Ellis County, Texas, Trial Court No. 55,282.

MEMORANDUM OPINION

Sharon L. Graham appeals the trial court's denial of Sharon's motion to reinstate her suit against Billie Graham. See Tex. R. Civ. P. 165a. In Sharon's first issue, she contends that the trial court erred in denying Sharon's motion to reinstate without an oral hearing. See TEX. R. CIV. P. 165a(3); Thordson v. City of Houston, 815 S.W.2d 550, 550 (Tex. 1991) (per curiam). Billie concedes that the trial court erred. We reverse and remand for further proceedings.
