Court of Appeal of California, First District, Division One
May 13, 1931
114 Cal.App. 117 (Cal. Ct. App. 1931)

Opinion

Docket No. 7934.

May 13, 1931.

APPEAL from a judgment of the Superior Court of Marin County. Edward I. Butler, Judge. Appeal dismissed.

The facts are stated in the opinion of the court.

Wallace Ware, Wilson, Haas Stevens, John J. Wilson and Jordan L. Martinelli for Appellants.

H.A. Postlethwaite and Joseph K. Hawkins for Respondent.

THE COURT.

Motion to dismiss appeal.

[1] It appears from the record that the appellants have failed to present or file with the trial court a notice of intention to appeal, or to request the preparation of the transcript within the time allowed by law and that such time has expired. It further appears that the time for the institution of proceedings for the settlement of a bill of exceptions has expired and that no such proceedings have been instituted or commenced.

The appeal is therefore dismissed.
