Grace v. Royal Indem

Supreme Court of Florida
Nov 20, 2007
970 So. 2d 824 (Fla. 2007)

Opinion

No. SC03-1272.

November 20, 2007.

Lower Tribunal No(s). 3D02-1245.

Petitioner has filed a document titled "Petitioner's Motion to Enforce. Mandate and Petition to Invoke `All Writs' Jurisdiction." To the extent. Petitioner seeks to invoke the Court's all writs jurisdiction, the petition is dismissed for lack of jurisdiction. See generally Denson v. State, 775 So.2d 288, 289 (Fla. 2000) ("an extraordinary writ petition cannot be used to litigate or relitigate issues that were or could have been raised on direct appeal or in prior postconviction proceedings"). To the extent Petitioner moves the Court to enforce its mandate, the motion is denied.

LEWIS, C.J., and WELLS, ANSTEAD, PARIENTE, QUINCE, CANTERO, and BELL, JJ., concur.
