Opinion

No. ED 78024

February 27, 2001

APPEAL FROM THE CIRCUIT COURT OF ST. LOUIS COUNTY, HONORABLE BERNHARDT DRUMM.

Douglas R. Hoff, 1221 Locust Street, Suite 350, St. Louis, MO 63103, for appellant.

JEREMIAH W. (JAY) NIXON, P.O. Box 899, Stephanie Morrell, Jefferson City, MO 65102, for respondent.

Before: Gary M. Gaertner, Sr., P.J., Lawrence G. Crahan, J., and George W. Draper III, J.

ORDER

Kevin Gowens (Movant) appeals the judgment denying, without a hearing, his Rule 24.035 motion for post-conviction relief. We have reviewed the briefs of the parties and the record on appeal and conclude the trial court's determination is not clearly erroneous. Rule 24.035(k). An extended opinion would have no precedential value. We have, however, provided a memorandum for the use of the parties only setting forth the reasons for our decision. We affirm the judgment pursuant to Rule 84.16(b).
