DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Suffolk County, dated April 14, 2021. Motion by the appellant for leave to amend the Table of Authorities contained in the appellant's brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, the appellant's brief is stricken, and on or before January 27, 2022, the appellant shall serve and file a replacement brief, via NYSCEF, which contains the corrected Table of Authorities, but otherwise contains the same content as the brief that was previously filed; and it is further, ORDERED that on the Court's own motion, the order on application of this Court dated December 17, 2021, is amended by deleting the entry thereof which directed the respondent-respondent to serve and file a brief on or before January 19, 2022, and the respondent-respondent shall serve and file a brief, if any, in response to the appellant's replacement brief within the time frame set forth in the Rules of the Appellate Division (see 22 NYCRR 1250.9[c]).
