ORDER

PER CURIAM.

Before the Court is Appellant Axiom, S.A. de C.V.'s motion to dismiss pursuant to Rule 42(a) of the Texas Rules of Appellate Procedure. We construe the motion as a motion to dismiss pursuant to Rule 42.1(a), which allows an appellate court to dismiss an appeal on the motion of an appellant. Tex.R.App.P. 42.1(a)(1). The motion states that only Appellant Axiom wishes to dismiss its appeal and that Appellant Juan Alvarez Gottwald intends to pursue his appeal. Accordingly, the motion to dismiss is granted only as to Appellant Axiom, S.A. DE C.V.

IT IS SO ORDERED.
