ORDER


After making an independent review of the pleadings, files, and records in this case, and the March 7, 2005 findings and recommendation of the magistrate judge, the court concludes that the findings and recommendation are correct and are therefore adopted. Even if the court disregards the sentence on page 2 of the findings and recommendation of the magistrate judge that plaintiff challenges in his objections, or accepts plaintiff's assertion as true, the result that the magistrate judge recommends is correct. Accordingly, this case is summarily dismissed as frivolous under 28 U.S.C. § 1915(e)(2) by judgment filed today.

SO ORDERED.
