TRUSTS, § 267insufficiency of evidence to establish resulting trust in favor of woman who had lived with deceased testator as his wife. Under evidence, held that chancellor was justified in finding that woman, who had lived with deceased testator apparently as his wife, although not legally married to him, was not equitable owner of proportionate share of realty, title to which was taken in testator's name, on ground that she had given testator, for investment purposes only, certain sum of money which testator had used in realty's purchase.

Appeal from the Circuit Court of Piatt county; the Hon. WILLIAM S. BODMAN, Judge, presiding. Affirmed in part and reversed in part and remanded with directions. Heard in this court at the October term, 1944.
