ORDER

On March 15, 2013, this court granted in part the parties' third joint motion to abate the appeal. We extended the abatement period until April 4, 2013, for the parties to finalize a settlement. We advised the parties that if they did not finalize a settlement by April 4, 2013, we would reinstate this appeal. To date, we have not received a motion to dismiss or a further motion for extension of time to finalize the settlement.

Therefore, we REINSTATE this appeal on the court's docket. We WITHDRAW the previous submission date of October 11, 2012. This appeal is set for formal submission ON BRIEFS ONLY before this court on Wednesday, May 8, 2013, before a panel consisting of Justice Angelini, Justice Marion, and Justice Alvarez.

It is so ORDERED on April 17, 2013.
