Marshall Lee GORE, Petitioner(s) v. STATE of Florida, Respondent(s).


Marshall Lee Gore is a prisoner under sentence of death and under an active death warrant, which was signed by the Governor on May 13, 2013. The date of the execution is set for Monday, June 24, 2013, at 6:00 p.m. On June 4, 2013, Steven Hammer filed his Notice of Appeal of the circuit court's orders of May 20, 2013, May 21, 2013, and June 4, 2013, and any and all other rulings adversely affecting Mr. Gore. The State moved to dismiss the Notice on June 4, 2013, and Steven Hammer filed a Motion for Stay of Execution on June 5, 2013. We deny relief sought by Mr. Hammer in his Notice of Appeal and his Motion for Stay of Execution. We also deny, as moot, the State's Motion to Dismiss. Noticeably absent from these filings is any substantive reason for granting a stay.

No rehearing will be entertained by this Court.
