Opinion

No. 83-2040.

July 13, 1984.

Appeal from Circuit Court, Polk County; Gunter Stephenson, Judge.

Marshall G. Slaughter and Jeff Holmes, Bartow, for appellant.

Jim Smith, Atty. Gen., Tallahassee and Robert J. Landry, Asst. Atty. Gen., Tampa, for appellee.

Since appellate counsel has withdrawn the first point on appeal, we deal only with point two — the alleged ineffective assistance of counsel claim.

We decline to address this claim at this time. The case is dismissed without prejudice for the appellant to seek an evidentiary hearing pursuant to Florida Rule of Criminal Procedure 3.850.

SCHEB and OTT, JJ., concur.
