Appeal from the City Court of the City of New York, New York County, BIRDIE AMSTERDAM, J.

Herman Itskowitz and I. Louis Friedman for appellant.

Clarence S. Barasch for respondent.


While the plaintiff's claim, that his letter of March 25, 1957 confirmed an agreement on all the essential terms of the proposed lease then reached between him, acting on behalf of the proposed lessee, and the defendant, is strongly discredited by the letter itself, nevertheless triable issues are present.

The order should be affirmed, with $10 costs and disbursements.
