AUTOMOBILES AND MOTOR VEHICLES, § 167.2rejection of testimony, as reversible error. In action by motorist for injuries sustained as result of an intersection collision, judgment for plaintiff would have to be reversed, where chief point in controversy was whether plaintiff had obeyed a stop sign before entering an intersection, and an attorney for defendant was not allowed to testify that a witness who asserted plaintiff stopped had told him the night before over the telephone that he had not seen the accident.

Appeal from Superior Court of Cook county; Hon. HARRY J. FLANDERS, presiding.

Reversed and remanded. Heard in first division, first district, this court at December term, 1939.
