ORDER TO FILE APPELLANT'S BRIEF
PER CURIAM
This cause is before the Court on appellant's fifth motion for extension of time to file the brief. Appellant's brief was originally due to be filed on May 15, 2023. Appellant's current counsel has been granted two extensions and now requests an additional thirty days. On October 25, 2023, appellant's counsel was ordered to file appellant's brief on or before November 13, 2023, and was instructed that further motions for extension of time would not be granted absent new and exigent circumstances.
The Court, having fully examined and considered appellant's fifth request for extension of time to file the brief and the extensions previously granted in this cause, is of the opinion that, in the interest of justice, appellant's motion for extension of time to file the brief should be granted with order. The Court looks with disfavor upon appellant's counsel to timely file appellant's brief.
Accordingly, appellant's fifth motion for extension of time to file the brief is hereby granted. IT IS THEREFORE ORDERED that the Honorable Diamond DeLeon, counsel for appellant, file the appellate brief with this Court on or before 5:00 p.m. on December 13, 2023. If the Honorable Diamond DeLeon fails to file the appellate brief with this Court on or before 5:00 p.m. on December 13, 2023, then the Honorable Diamond DeLeon is ORDERED to appear in person on December 14, 2023, at 10:00 a.m. in the Courtroom of the Thirteenth Court of Appeals, located at the Nueces County Courthouse, 901 Leopard Street, 10th Floor in Corpus Christi, Texas, to show cause why he should not be held in contempt of court.
