Gonzalez v. State

District Court of Appeal of Florida, Second District
Jun 20, 1979
372 So. 2d 196 (Fla. Dist. Ct. App. 1979)

Opinion

Nos. 78-1828, 78-2162.

June 20, 1979.

Appeals from Circuit Court, Hillsborough County; Harry Lee Coe, III, Judge.

Jack O. Johnson, Public Defender, Bartow, and Wayne Chalu, Asst. Public Defender, Tampa, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Eula Tuttle Mason, Asst. Atty. Gen., Tampa, for appellee.

We remand so that the lower court may correct the written order revoking appellant's probation to conform to the court's oral pronouncement, by striking the finding of violation of condition 4. We otherwise affirm the order of revocation, and the judgments and sentences.

OTT, Acting C.J., and RYDER and DANAHY, JJ., concur.
