Dolores GONZALEZ, Appellant v. DISCOVER BANK, Appellee
From the 49th Judicial District Court, Webb County, Texas Trial Court No. 2023CVH000968D1 Honorable Jose A. Lopez, Judge Presiding
ORDER
Beth Watkins, Justice
On June 26, 2024, we ordered appellant to provide written proof by July 8, 2024 that she had requested the preparation of the reporter's record. Our order noted that if appellant did not request the reporter's record in writing, her brief would be due 30 days from the date of the order, and we would consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).
Appellant did not file written proof in this court showing that she had requested the reporter's record. Accordingly, her brief was due by July 26, 2024. As of the date of this order, appellant has not filed either the brief or a motion for extension of time. We therefore ORDER appellant to file, by August 29, 2024:
(1)her brief; and
(2)a written response reasonably explaining: (a) her failure to timely file a brief; and (b) why appellee is not significantly injured by appellant's failure to timely file a brief.
If appellant fails to timely file a brief and the written response, we will dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a); see also Tex. R. App. P. 42.3(c) (allowing involuntary dismissal if appellant fails to comply with court order).
